1. Scope and provider
These Terms of Service apply to all orders placed by consumers through the online store of TEMPEL Design.

Our store is intended exclusively for consumers (B2C).
2. Contract partner
The purchase contract is concluded with TEMPEL Design, owner Max Tempel.
3. Offer and conclusion of contract
The presentation of products in our online store does not constitute a legally binding offer, but a non-binding invitation to place an order.
By completing the checkout process, you submit a binding offer to purchase the goods contained in the shopping cart.
After receipt of your order, you will usually receive an automatic order confirmation by email. This confirmation merely documents receipt of the order and does not yet constitute acceptance of your offer.
A contract is only concluded when we expressly accept your order by shipping confirmation or dispatch the goods.
We reserve the right to refuse orders in individual cases, in particular in the event of obvious pricing or product errors, technical errors, non-availability, suspicion of fraud or misuse, or other objectively justified reasons.
4. Products and availability
We currently sell primarily clothing and textile-related goods under the TEMPEL, TEMPEL 101, and TEMPEL Athletics lines.
Products may be available only in limited quantities. If an ordered item becomes unavailable after the order has been placed, we will inform you as soon as possible. Payments already made for unavailable items will be refunded.
Minor differences in color, feel, embroidery, branding, dimensions, positioning, or finish may occur due to screen display, lighting conditions, material characteristics, hand-finishing, production tolerances, or batch-related variations, insofar as reasonable for the customer.
5. Prices and currencies
Prices displayed in the shop are final prices where applicable.
Depending on the delivery country, tax region, customs region, and checkout setup, taxes, duties, customs charges, or import costs may be handled differently.
For deliveries within the EU, prices are generally shown including applicable VAT. For deliveries outside the EU, additional import duties, customs charges, taxes, or fees may apply and are to be borne by the buyer unless stated otherwise during checkout.
Our base prices may be maintained in EUR. Prices shown in other currencies may be converted and rounded by Shopify or the applicable system.
6. Payment
Payment is due immediately in the course of the checkout process.
The store may offer payment methods such as:

- Apple Pay,

- Bancontact,
- BLIK,

The payment methods shown in an individual case depend in particular on region, device, payment profile, and technical availability.
7. Retention of title
Goods remain our property until full payment has been made.
8. Delivery
Delivery is made from Germany to the delivery address specified during checkout.
The shipping conditions displayed in the shop, checkout, or shipping policy at the time of the order apply.
You are responsible for providing complete and correct delivery information. We are not liable for delays, delivery issues, or extra costs caused by incorrect or incomplete address details unless we are responsible for them.
We try to avoid partial shipments for cost and environmental reasons. However, partial deliveries are permitted where necessary and reasonable.
9. Withdrawal, returns, and exchanges
Consumers have the statutory right of withdrawal.
In addition, we may grant a voluntary 30-day return policy. Details are set out in our Return & Refund Policy.
10. Warranty
Statutory warranty rights apply.
If you receive obviously damaged goods, wrong goods, or defective goods, please contact us as soon as possible via the contact form on our website where available, or by email at support@tempel.design.
11. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, under the Product Liability Act, and in all other cases in which liability is mandatory by law.
In the event of slightly negligent breach of essential contractual obligations, our liability is limited to the typical foreseeable damage.
Otherwise, liability for slightly negligent breaches of duty is excluded to the extent permitted by law.
12. Contract language and applicable law
The contractual language is the language used in the respective checkout or order process.
If several language versions of these Terms are provided, the German version serves as the reference version unless mandatory consumer protection rules provide otherwise.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in another country, mandatory consumer protection provisions of that country remain unaffected.
13. Consumer dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
